Permits, inspections, and AHJ rules

How to tell whether you need a permit, how to file one, what each inspection actually checks, and how to avoid the corrections that fail most often.

Permit thresholds, licensing limits, and inspection procedures vary by city, county, and state. Confirm everything here with your local building department before starting work.

Who actually has the final say
The NEC is a model code. Your jurisdiction decides what is enforced.
  • The NEC (NFPA 70) is published every three years, but it only has legal force where a state, county, or city adopts it. Many jurisdictions run an edition that is 3-9 years old.
  • Adopted editions are usually amended locally. Amendments can add requirements (e.g. conduit required in certain occupancies) but rarely remove safety rules.
  • The AHJ — Authority Having Jurisdiction — is the office or inspector empowered to interpret and enforce the code. Their interpretation outranks your reading of the book.
  • The AHJ can require more than the NEC, can approve alternate methods, and can reject a listed product used outside its listing.
  • Manufacturer instructions are enforceable: NEC 110.3(B) makes installing equipment contrary to its listing a code violation.
  • To find your rules: search "<your city or county> electrical code amendments", or call the building department and ask which NEC edition is enforced and whether homeowner permits are allowed.
  • Utility rules are separate from the building code. Meter location, service height, and clearances often come from the utility's own service manual.
Do I need a permit?
Pick the job to see the typical answer — then confirm locally.
  • General rule: replacing an existing device like-for-like usually does not need a permit. Adding, extending, or altering circuits usually does.
  • Anything touching the service — meter, service conductors, panel, grounding electrode system — almost always needs a permit and often a licensed electrician.
  • Permits are cheap relative to the risk. Unpermitted electrical work is a common reason insurance claims get denied and sales get delayed.

How to file a permit, step by step
The process is mostly paperwork and scope description.
  • 1. Identify the AHJ for the address. City limits vs unincorporated county matters — the wrong office wastes a week.
  • 2. Decide the permit type: homeowner/owner-occupant permit (allowed in many but not all jurisdictions, only for your own residence) or licensed contractor permit.
  • 3. Write the scope of work in plain terms: "Add one 20 A dedicated circuit and GFCI receptacle in garage" or "Replace 100 A panel with 200 A service."
  • 4. Gather supporting documents: circuit count, load calculation for service or panel work, panel schedule, a simple site or floor plan, and equipment specs for EV chargers or generators.
  • 5. Submit online through the building department portal, or in person. Pay the fee — commonly $50-$150 for a small residential circuit permit and several hundred for a service change.
  • 6. Wait for issuance. Simple over-the-counter permits are often same day; plan review for services or additions can take days to weeks.
  • 7. Post the permit at the job site and keep the approved documents accessible for the inspector.
  • 8. Schedule inspections as the work reaches each stage, and do not cover work that has not been inspected.
  • Permits expire — typically 6-12 months — and usually require an inspection activity to stay alive. Close out the permit; an expired open permit shows up in a title search.
The inspection sequence
What each visit checks, and how to be ready for it.
  • Underground / trench inspection: depth of burial, conduit type and bedding, warning tape, and conductor type before backfill.
  • Rough-in inspection: happens after wiring is installed and before insulation and drywall. The inspector checks box fill, cable support and stapling, cable protection through studs (nail plates), box mounting and setback, splices, grounding, conductor sizing, and that nothing is buried.
  • Service inspection: panel mounting and clearances (NEC 110.26), grounding electrode conductor and bonding, meter base, service conductor sizing, main bonding jumper, and neutral/ground separation in subpanels.
  • Final inspection: devices and covers installed, GFCI/AFCI protection present and testing correctly, fixtures and appliances connected, panel directory filled in legibly, tamper-resistant receptacles where required, smoke and CO alarms in place, and everything energized and functional.
  • How to prepare: leave all boxes accessible, keep the panel cover off but the panel de-energized where appropriate, have the permit and plans on site, torque terminals to spec, and label circuits before the inspector arrives.
  • Be on site if you can. A five-minute conversation often turns a correction into an approval with a note.
  • If work fails, you get a correction notice listing items and a re-inspection (sometimes with a fee). Fix everything on the list before calling back — a second fail on the same item is a credibility problem.
What fails inspection most often
Each of these has a simple fix if you catch it first.
  • Missing AFCI or GFCI protection — fix: verify the required locations for your adopted NEC edition before you buy breakers, not after.
  • Overfilled boxes — fix: count conductors, devices, and clamps against the box's cubic-inch rating; go up a box size or add a box.
  • Unsupported or unstapled cable — fix: staple within 8 inches of a single-gang plastic box (12 inches for other boxes) and every 4.5 feet along the run.
  • Cable too close to the stud face — fix: keep 1.25 inches of setback or install a steel nail plate.
  • Missing cable clamps or anti-short bushings on armored cable — fix: install the listed connector and red-head bushings on every AC/MC termination.
  • Neutral and ground bonded in a subpanel — fix: remove the bonding screw/strap and land neutrals on an isolated neutral bar.
  • Unlabeled or vaguely labeled panel directory — fix: label by specific use and location, not "lights."
  • No working clearance at the panel — fix: 30 inches wide, 36 inches deep, 6.5 feet high, clear and dedicated; no shelving or plumbing above it.
  • Wrong wire gauge for the breaker — fix: 14 AWG copper for 15 A, 12 AWG for 20 A, 10 AWG for 30 A; the breaker protects the wire.
  • Reversed polarity or open ground at receptacles — fix: test every device with a plug-in tester and correct before the final.
Working with your inspector and gray areas
Ask early, get it in writing, stay easy to work with.
  • Ask about gray areas before you install, not at inspection. Inspectors answer pre-installation questions readily; they hate being asked to bless finished nonstandard work.
  • Get interpretations by email so the answer travels with the job and survives inspector turnover.
  • Cite the article when you disagree, politely, and ask which section they are applying. If it stays unresolved, most jurisdictions have a formal appeal or a chief inspector review.
  • Do not argue on site in front of the customer. Take the correction, verify the code, then follow up through the office.
  • Unpermitted existing work discovered mid-job becomes your problem to describe accurately. Document what you found in writing before you touch it.
  • Retroactive permits are usually possible: you pull the permit, expose the work for inspection, and correct what fails. Cheaper than a denied claim or a failed sale.
  • Insurance and resale both hinge on permits. A claim after a fire can be denied when the work was unpermitted, and unpermitted work must be disclosed in most states.
